Functions/Services of the Department Legal Department of Brihanmumbai Mahanagarpalika is concerned with litigation for and on behalf of BMC as well as against the Corporation with respect to the action taken under various provisions of the MMC Act, 1888 and other Acts, such as Maharashtra Regional and Town Planning Act, 1966, D.C. Rules & Regulations, The Bombay Shops & Establishment Act, 1948, The Prevention of Food Adulteration Act, 1954, The Maharashtra Urban Areas (Urban Areas) Preservation of Trees Act, 1975, etc. The litigations are both civil and criminal in nature spread over in various different Courts of Law extending to the Writ Jurisdiction in the High Court and the Supreme Court and also in Small Causes Court, Tribunal, Labour and Industrial Court, Co-operative Court, Consumer's Redressal Forum, Civil and Criminal Courts and as well as the courts situated outside Mumbai. It also deals with the preparation of all types of Agreements, Lease, Conveyance, Memorandum of Understanding in respect of Municipal Properties and matters and investigation of titles of the properties to be taken over by the Corporation as per D.C. Regulations and M.R.T.P Act. Legal Department also gives legal opinion to the civic administration as and when sought for. Advocates, i.e. Jr. Law Officer, Asstt. Law Officer and Dy. Law Officer appear and plead on behalf of the BMC in the various Hon'ble Courts in Mumbai. As the department deals with legal proceedings, there is no question of any decision. 3. Committee for prevention of Sexual harrassment in office (Internal Complaint Committe) The Committee is already formed in the Head Officer of BMC and Department Level. No independent committee is formed for the Legal Department. 8. Important Achievements In order to automate pending legal cases information (around 70000 Nos) INTEGRATED LITIGATION MANEGMENT Solution is being implemented. 9.
